Privacy Policy

1.1. Data controller

The controller of the personal data collected through the Website is WeLaunch LLC, a limited liability company organized under the laws of the State of New Mexico (United States), operator of the “AvatarHype” brand. Contact email: hello@avatarhype.online. Because the Website advertises and sells to residents of the European Union, the EU General Data Protection Regulation (GDPR) applies extraterritorially (Art. 3(2) GDPR) to visitors in the European Economic Area. Visitors in the United States are covered by the applicable state privacy laws (including California’s CCPA/CPRA).

1.2. Data we process

The Website has no user accounts, sign-up forms or profiles. The purchase, payment and course access are handled entirely through Whop.com. The data processed through the Website is primarily browsing and ad-measurement data collected via cookies and similar identifiers (see the Cookie Policy below): the country-level pricing region detected by geolocation, pseudonymous analytics and ad-attribution identifiers (Meta, TikTok, Google Analytics, PostHog), and campaign parameters (utm_*).

Server-side processing: when a purchase is completed on Whop, Whop sends us a server-to-server notification (webhook) with the transaction data. From it, our server forwards conversion data — including pseudonymized/hashed identifiers (for example, a hashed email) and the amount — to the Meta Conversions API (CAPI), Google (Measurement Protocol), TikTok (Events API) and Snap (Conversions API) for ad measurement and attribution, and may send the confirmation email via Resend. The IP address and user agent may also be processed when creating the checkout session. This server-side measurement works independently of any browser cookie settings.

1.3. Data we do NOT collect

Through the public pages of the Website, AvatarHype does not store in its own systems: names; phone numbers; postal addresses; payment data (cards, bank accounts); passwords or credentials; nor the IP address beyond its incidental use for country-level geolocation and measurement. Payment and course-account data are processed exclusively by Whop.

1.4. Purposes and legal bases

For visitors subject to the GDPR, the legal bases for each processing activity are as follows:

Transparency: these analytics and marketing tools currently load on the basis of legitimate interest, without a prior consent banner. If you do not wish to be subject to analytics or advertising measurement, you may object or opt out at any time using the mechanisms described under “How to control cookies and tracking” in the Cookie Policy, together with your browser settings.

1.5. Processors and third parties

To run the service we rely on the following providers, which may process data on our behalf or as independent controllers. Most are based in the United States:

• Snap Inc. (USA) — Snap Pixel and Conversions API for ad measurement on Snapchat.
• PostHog, Inc. (USA) — product analytics and session replay (with form inputs masked).
• Resend (USA) — transactional email (confirmations and purchase recovery).
• Vercel, Inc. (USA) — hosting, content delivery network (CDN) and geolocation headers.
• Bunny (BunnyWay d.o.o., Slovenia, EU) — video delivery (CDN).

1.6. International transfers

The controller and most providers are located in the United States, so processing data from EEA visitors involves an international transfer. Depending on the provider, these transfers rely on the EU-US Data Privacy Framework for those providers that are certified under it at the relevant time (verifiable in its official list) and, for all other providers, on the European Commission’s Standard Contractual Clauses or other safeguards under Article 46 GDPR.

1.7. Data retention

Functional cookies are kept for up to 1 year or until the user deletes them. Analytics and marketing cookies are kept according to each provider’s periods (see the cookie tables). Conversion data sent to the ad platforms is retained per each platform’s policy. AvatarHype keeps no personal-data databases of its own for the public pages of the Website.

1.8. Your rights (EEA visitors — GDPR)

Under Articles 15 to 22 GDPR, you have the right to: access, rectification, erasure, restriction of processing, portability and objection, as well as to withdraw consent at any time without retroactive effect. To exercise them, write to hello@avatarhype.online with the subject “GDPR rights request”. We will respond within one month (extendable in complex cases, Art. 12(3) GDPR).

1.9. Your rights (US visitors — CCPA/CPRA and state laws)

Residents of California and of other states with applicable privacy laws may have the right to: know and access the personal information we process; request its deletion; request its correction; and opt out of the “sale” or “sharing” of personal information (which, under the CPRA, may include sharing identifiers with ad platforms such as Meta, TikTok or Google). We will not discriminate against you for exercising these rights. We honor the Global Privacy Control (GPC) signal as a valid opt-out where technically detectable. To exercise these rights, contact us through the same channel given in section 1.8, with the subject “Do Not Sell or Share / Privacy Request”.

1.10. Complaints

EEA visitors may lodge a complaint with their supervisory authority. In Spain, the Spanish Data Protection Agency (AEPD): C/ Jorge Juan, 6, 28001 Madrid — https://www.aepd.es. US residents may contact their state Attorney General.

Terms & Conditions

2.1. Operator identification

The Website avatarhype.online and the products are offered under the “AvatarHype” brand. The operator’s full details are in the “Operator details” section of this document.

2.2. Purpose

These Terms & Conditions (the “Terms”) govern access to and use of the Website and the purchase of the digital products offered through it. Accessing the Website and/or purchasing any product implies full acceptance of these Terms. If you do not agree, you must refrain from using the Website and from purchasing the products.

2.3. Service description

AvatarHype is a digital training platform that teaches how to create ecommerce ads with artificial intelligence (among others: hyper-realistic UGC-style content, animated content and image ads) at low cost and without creators or agencies. The products are one-time-payment digital courses (not a subscription) with lifetime access, available individually or as a bundle. The training content and access are delivered through Whop.com.

2.4. Price and payment

Prices are shown in the local currency for the detected region. Struck-through prices (“previous price”), where shown, are a reference price for information and marketing purposes and are not a time-limited promotion; the effective price is the non-struck one next to the buy button.

All payments are processed through Whop, which acts as the Merchant of Record for the transaction; AvatarHype is the provider and seller of the training content. When you click the buy button, you are redirected to Whop.com to complete payment. AvatarHype does not process, store or access your payment data. The payment process is also governed by Whop’s terms (https://whop.com/terms/).

2.5. Delivery of the digital product

The product is digital content delivered immediately upon payment confirmation. There is no physical shipment. Course access is managed through your account on Whop.com.

2.6. Refunds and right of withdrawal

30-day money-back guarantee: we offer a 30-calendar-day money-back guarantee from the date of purchase. If you are not satisfied for any reason, you may request a full refund by writing to hello@avatarhype.online with the subject “Refund request”, stating the email associated with the purchase and the approximate date. We normally initiate the refund within five (5) business days; the refund is issued by Whop as Merchant of Record and may take a few additional days to appear depending on your bank.

Right of withdrawal (EU consumers): under Directive 2011/83/EU and its national transpositions (in Spain, Art. 103(m) of Royal Legislative Decree 1/2007), the 14-day right of withdrawal does not apply to the supply of digital content not on a tangible medium where performance has begun with the consumer’s prior express consent and acknowledgement that the right is thereby lost. By accessing the content immediately after purchase, the consumer provides such consent. In any case, the 30-day money-back guarantee above offers stronger protection.

2.7. Intellectual property

All course content (text, videos, images, templates, tools and other materials) is the exclusive property of AvatarHype or its licensors and is protected by applicable intellectual-property law. The purchase grants a personal, non-exclusive and non-transferable license for personal training purposes. Without prior written authorization it is prohibited to: reproduce, distribute or make the content publicly available; resell, sublicense or share credentials; or create derivative works. Breach may lead to revocation of the license without a refund, without prejudice to applicable legal action.

2.8. Age requirement

To purchase, you must be at least eighteen (18) years old or the minimum legal age to contract in your jurisdiction. By purchasing, you represent that you meet this requirement.

2.9. Limitation of liability

AvatarHype provides educational content. Results depend on factors outside our control (effort, prior knowledge, market conditions), so we do not guarantee income or specific economic results; any example is purely illustrative. We do not guarantee uninterrupted availability of the Website. We are not responsible for the content of linked third-party sites. To the maximum extent permitted by applicable law, AvatarHype shall not be liable for indirect, incidental or consequential damages, or for loss of profit.

2.10. Governing law and dispute resolution

Except where mandatory law provides otherwise, these Terms are governed by the laws of the State of New Mexico (United States), without prejudice to the mandatory consumer-protection rights available to you under the law of your country of residence (EU consumers retain the protection of their local rules). For EU consumers, the European Commission provides an online dispute resolution (ODR) platform: https://ec.europa.eu/consumers/odr/.

2.11. Severability

If any clause is held void, the remaining clauses remain in force.

3.1. What cookies are

Cookies are small text files a website stores on the user’s device to make it work, remember preferences or measure its use. Alongside them we use similar identifiers stored in the browser (for example, in localStorage or first-party cookies) for ad-attribution purposes.
